Civil and Political Rights Committee at the National Institution for Human Rights holds its Seventh Regular Meeting

The Civil and Political Rights Committee at the National Institution for Human Rights (NIHR) held its seventh regular meeting under the chairpersonship of Mrs. Jameela Ali Salman and the participation of Mr. Khalid Abdulaziz Al-Shaer and Dr. Bader Mohamed Adel.

The Committee discussed a proposal that includes setting a specific date to appeal the decisions made by the Administrative Agency before the Administrative Department in the Civil Court, through specifying a 60-day period which starts on the day of publishing the appealed decision in the Official Gazette or in newsletters issued by public entities, or the declaration of parties concerned. The Committee indicated the need to set a date to challenge the decisions, given its positive side effects on the stability of legal positions, especially since the Bahraini judiciary, in light of the legislative vacuum in dealing with the aforementioned article, has resorted to the prevailing custom, considering it the second source of legislation. It settled on the necessity of filing an appellate suit during a sufficient period of 60 days, not including what the special provisions stipulate concerning different time periods to challenge administrative decisions, as these periods concern specific laws and do not encompass all decisions. The Committee decided to mandate the Secretariat-General for further research about the aforementioned proposal and to benefit from other countries’ experiences.

The Committee also reviewed all of its achievements since the issuance of the Royal Decree No. (7) of the year 2013 on reformation of the NIHR's Council of Commissioners, and the Royal Decree No. (20) of the year 2015 appointing members of the NIHR's Council of Commissioners, in order to conduct periodic evaluations of the Committee’s work. It was decided the Committee’s following meeting will be on January 18th, 2016.
